Terms and Conditions (UK, Australia, and New Zealand)

1. Acceptance of These Terms

By accessing or using checker.cv (the “Service”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

2. Who We Are

The Service is operated by Checker CV (the “Operator”), based in Waitoki, New Zealand.

3. The Service

Checker CV is a software tool that:

  1. Allows you to upload a PDF CV;
  2. Uses the OpenAI API to analyse and rewrite the text; and
  3. Produces a downloadable Microsoft Word (.docx) file.

4. Eligibility and Authority

You must be able to enter into a legally binding contract. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation.

5. Your Content and Permissions

5.1 Your Content

You retain all rights in the content you upload (“User Content”). You represent and warrant that you own or have the necessary rights to upload and process the User Content.

5.2 Licence to Provide the Service

You grant the Operator a limited, non-exclusive licence to host, process, and transform your User Content solely to provide the Service (including generating the .docx output) and to comply with legal obligations.

6. 24-Hour Auto-Deletion (Data Destruction)

Checker CV enforces a strict 24-hour auto-deletion policy. The uploaded PDF, any parsed text, and the generated Word document are permanently destroyed from our cloud servers exactly 24 hours after upload.

You are responsible for downloading and saving your generated .docx before deletion.

7. Important Disclaimers (No Guarantees)

Checker CV is a software tool and is not a recruitment agency, career service, or law firm. We make no guarantees regarding:

  • Job placement or interview outcomes;
  • Employer decisions or hiring processes;
  • ATS compatibility or ATS scoring;
  • Visa approvals or immigration outcomes.

You are solely responsible for reviewing and verifying the output for factual accuracy (including possible AI errors) before using it.

8. Immigration Disclaimer (NZ/AU — Critical)

We are not Licensed Immigration Advisers (New Zealand) and we are not registered migration agents (Australia).
We do not provide immigration advice, migration advice, or any regulated immigration services. Nothing on the Service constitutes immigration advice, legal advice, or professional advice. If you require immigration assistance, you should consult a properly licensed/registered professional in your jurisdiction.

9. Payments, Pricing, and Stripe

9.1 One-Time Fee

The Service is provided for a one-time fee per transaction as displayed at checkout.

9.2 Payment Processor

Payments are processed by Stripe. We do not store full payment card numbers.

9.3 Taxes

Prices may be shown inclusive or exclusive of applicable taxes depending on your location and applicable law. You are responsible for any taxes or duties except where we are required to collect them.

10. Digital Content Waiver (UK/EU Consumers — 14-Day Withdrawal)

If you are a consumer in the UK or EEA/EU and you purchase digital content that is not supplied on a tangible medium, you may normally have a 14-day statutory right of withdrawal.

By initiating the generation of the digital content, you explicitly consent to its immediate delivery and acknowledge that you lose your 14-day statutory right of withdrawal.

11. Refunds and Cancellations

Except where required by applicable law, all sales are final and non-refundable, because the Service is an instantly delivered digital product and we incur unrecoverable third-party API computing costs upon processing.

This does not affect your rights under any applicable consumer law that cannot be excluded.

12. Affiliate Links and Third-Party Services

The Service may include affiliate links to third-party products or services. We may earn a commission at no extra cost to you. We are not responsible for third-party services, content, or policies.

13. Prohibited Use

You agree not to:

  • Upload unlawful, infringing, deceptive, or harmful content;
  • Use the Service to create fraudulent or misleading documents;
  • Attempt to interfere with or gain unauthorised access to the Service;
  • Reverse engineer or misuse the Service or its providers.

14. Intellectual Property

The Service, software, branding, and all related intellectual property are owned by the Operator or its licensors. You may not copy, modify, distribute, or create derivative works of the Service except as permitted by law.

15. Service Availability and Changes

We may modify, suspend, or discontinue the Service at any time. We may update these Terms by posting a revised version on checker.cv and updating the “Last Updated” date.

16. Disclaimers and Limitation of Liability

16.1 Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind.

16.2 Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive losses, including loss of profits, loss of opportunity, or reputational harm.

Our total liability for any claim relating to the Service will not exceed the amount you paid for the transaction giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations; in that case, these limits apply to the greatest extent permitted.

17. Indemnity

You agree to indemnify and hold harmless the Operator from claims arising out of your use of the Service, your User Content, or your breach of these Terms.

18. Governing Law and Exclusive Jurisdiction (New Zealand)

These Terms and any dispute arising out of or relating to the Service are governed exclusively by the laws of New Zealand, and you agree that the courts of New Zealand have exclusive jurisdiction.
